This Terms and Conditions document governs the use of Maxshop.com Online Services (the Service) including shopping and participation in promotions run by Maxshop.com. You can access this Agreement at any time from the bottom of any page of the site.

Purchasing from Maxshop.com

Maxshop.com shopping gives customers convenient, quick, easy and secure shopping.

Products displayed on the site shopping areas can be purchased using secure online Mastercard, Visa, Diners Club and American Express transaction facility. Customers can be confident that all of their details are protected by the latest security mechanisms and are used only for purposes of the transaction fulfillment. The name that will appear on your statement will be Max Fashions Ltd.

You will be asked to register as a Max Customer. Apart from the many member benefits, including receiving regular emails containing special deals, your shopping address details will be filed saving you the effort of entering these details each time you checkout.


All prices in the shopping areas are in New Zealand dollars (NZ$). All prices are correct at time of publication, however we reserve the right to alter prices for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.


We use the secure Hosted Payment page solution from DPS to process online orders. Customers can see their cards being authorized and debited in real time, all in an SSL secure environment. The Hosted Payment page enables us to offer customers a safe and speedy online shopping experience.

DPS is committed to protecting the security of your data. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use or disclosure. For example, we store the personal information you provide in computer servers with limited access that are located in controlled facilities secured by the latest in surveillance and security technology. When we transmit sensitive information (such as a credit card numbers) over the internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. Credit card details stored on site are encrypted using 168bit 3DES encryption. DPS is also certified AIS compliant.

Use of the Service by You

Your right to use the Service is personal to you. You may not authorise others to use the Service, and you are responsible for all of your own use of the Service.

You may not download, modify, transmit, or otherwise use any material from the Service for public or commercial purposes.

The Service's content, information and advice are free of charge (unless otherwise stipulated). However you are responsible for your own network and connection charges.

Other than connecting to the Maxshop.com servers by HTTP requests using a web browser, you may not attempt to gain access to Maxshop.com servers by any means including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Service or otherwise.

You agree not to disrupt, modify or interfere with the Service or its associated software, hardware and servers in any way and you agree not to impede or interfere with others use of the Service. You further agree not to alter or tamper with any information or materials on, or associated with, Maxshop and/or the Service.


Maxshop is a trademark of Max Fashions Limited. The copyright and other intellectual property rights in the material contained in the Service are protected by Max Fashions Limited.


Maxshop.com will over time provide content and information which children may find interesting and may wish to access. However, no one under the age of 13 years is allowed to provide any personal information. Minors under the age of 18 years are prohibited from making purchases, including subscriptions, on the Service.


This Service provides general information about Max Fashions Limited and the products and services they offer. The information contained in the Service has been prepared solely for the purpose of providing information about Maxshop.com, its subsidiaries and the services and products they offer. Maxshop.com reserves the right to change, delete or move any of the material on the Service at any time without notice.

Maxshop.com and its affiliates shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access the Service. This includes viruses alleged to have been obtained from the Service, your use of or reliance on the Service or any of the information or materials available on the Service, regardless of the type of claim or the nature of the cause of action.

All giftcards (E-giftcard & Physical Giftcards) are valid for 12 months from issue date (for e-giftcards this is the date that the email is received on).

Max Dollars Rewards Programme Terms & Conditions


  • Full price product means product purchased at the original ticketed price.
  • Promotional product means full price product that has a discount or new price applied, either instore or online, for a limited period of time.
  • Sale product means product sold in the sale section instore or online, or marked as sale product online, that has had the price permanently reduced to clear.
  • Outlet product means all product sold in Max outlet stores or marked as outlet product online that has had the price permanently reduced to clear.


  • Anyone can join the Max Dollars Rewards Programme by visiting instore or signing up online.
  • No purchase is required to join the Max Dollars Rewards Programme.
  • Max may alter the programme from time to time by written notice to members to their registered email addresses.


  • Max Dollars (M$) can be earned on purchases instore and online.
  • Programme members must identify themselves instore, or login as a Max Dollars member online when making a purchase. Max Dollars cannot be added to their account at a later date.
  • The programme has two tiers: Black and Gold
  • o Black: members who spend up to $500 per year have Black status and earn M$1 for every $20 spent on full price product or promotional product (excludes sale product and outlet product). o Gold: members who spend over $500 per year have Gold status and earn M$1 for every $10 spent on full price or promotional product and M$1 for every $20 spent on sale or outlet product.
  • Max Dollars are not earned on the portion of a purchase paid for with Max Dollars.
  • Max Dollars are not earned on the purchase of gift card but are earned when the gift card is spent.
  • From time to time Max will run promotions to give members the opportunity to earn additional Max Dollars. These promotions are run at Max’s discretion.
  • Members can view their Max Dollars balance any time by logging into their account at Maxshop.com.
  • At its discretion, and at any time, Max may reverse, cancel or vary Max Dollars earned in error, or earned fraudulently.
  • Max Dollars do not represent legal tender in any country.
  • The currency in which Max Dollars are earned will be NZD if your purchase is made in New Zealand, and AUD if your purchase is made in Australia.
  • $1MD = $1NZD for New Zealand purchases. $1MD = $1AUD for Australian purchases.


  • Max Dollars can be redeemed for goods at any Max store and online at www.maxshop.com
  • Max Dollars can be used as a partial payment. Members will be asked apply the amount of Max Dollars they wish to spend first and pay the balance with any other payment method accepted by Max.
  • Max Dollars cannot be used as a deposit or payment method on a layby transaction but can be used as a partial payment with Afterpay (see above).
  • Max Dollars can only be redeemed once.
  • Max Dollars cannot be used once they have expired.
  • Max Dollars cannot be used to purchase Max gift cards.
  • Max Dollars cannot be transferred, sold, assigned, or gifted.
  • Max Dollars cannot be converted to cash, gift cards, credit notes, or any other payment method.


  • Members enter the Max Dollars programme at Black status (see earn rates above).
  • If the members first purchase is over $500, the member will be upgraded to Gold status for future purchases.
  • A member’s tier in the Max Dollars programme will be determined by calculating their spend at Max in the previous 12 months. The status is calculated and updated overnight after the day of purchase.
  • The transaction that qualifies a member for Gold status does not earn Max Dollars at the Gold rate. Subsequent transactions will be at Gold rate.
  • When a member achieves Gold status, that status will be maintained for 12 months from the date of achieving Gold.
  • If a Max Dollars member account records no purchases within a 2-year period, Max reserves the right to remove the member from the Max Dollars programme.


  • Max Dollars are valid for 6 months from date of issue.
  • Unspent Max Dollars will be removed from the members account on the 6 month anniversary of the day they were earned.
  • Gold members will be given a 6 month extension on the expiry of their Max Dollars. This will be automatically applied to their account.


  • Any Max Dollars earned on a purchase that is subsequently returned will be deducted from the members Max Dollars balance.
  • When a product is returned, last 12 month spend will be updated to reflect the total spend once the product has been returned. This may result in a negative Max Dollar balance if some of the Max Dollars had already been spent.
  • If a returned product takes the member under the “$500 spend in the past 12 months” threshold for Gold status, their status will be moved from Gold to Black.


  • If a member opts-in to receive emails, Max will provide regular updates on the Max Dollar balance on their account, information on how to earn additional Max Dollars, and the date and amount of the next Max Dollars expiring.

Click & Collect

We do our best to make sure the items you ordered will be available in the specified timeframe, however we cannot guarantee that the items you ordered will always be available. On this unfortunate and rare occasion, a store representative will phone you to let you know.

Click and Collect Orders will be reserved for 2 business days from the time you receive a confirmation email, text message or phone call saying that your order ready in store. If you do not arrive within 2 business days, the items you ordered may no longer be reserved for you.
